This page explains the rules for using Ambify (the “Service”) and how we collect and process personal data when you use our website and related services.

A. Terms of Service

1. Who we are and what these Terms cover

Ambify (“Ambify”, “we”, “our”, “us”) provides ambient audio playback, mixing controls, presets, and related account features through our website and associated services (collectively, the “Service”).

The legal business name is ambify. Ambify is operated by an individual based in Germany. These Terms of Service (the “Terms”) form a legally binding agreement between you and Ambify and govern your use of the Service.

2. Acceptance and eligibility

By accessing or using the Service, or creating an account, you confirm that you have read and understood these Terms and agree to be bound by them.

You must be at least the age of majority in your jurisdiction to use the Service. If you are under the age of majority, you may use the Service only with consent of a parent or legal guardian.

3. Public beta status

Ambify is currently offered as a free public beta. During beta, features may change, be limited, interrupted, or removed at any time.

We may introduce paid plans after beta. If billing is enabled in the future, we will update these Terms and related policies before paid access is activated.

4. Accounts and security

If you create an account, you agree to provide accurate and up-to-date information and keep your credentials confidential. You are responsible for all activity under your account.

You must not sell, rent, share, or transfer account credentials to others. If you believe your account is compromised, contact support@ambify.io immediately.

5. License to use the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal use as intended by Ambify.

6. Acceptable use

You agree not to misuse the Service. You must not:

  • attempt unauthorized access, security testing, or bypass protective measures;
  • copy, scrape, or harvest data in ways that harm the Service or violate these Terms;
  • reverse engineer or attempt to derive source code except where prohibited by law;
  • interfere with availability, integrity, or other users' access;
  • use the Service in ways that violate applicable law or third-party rights.

7. User content (favorites and presets)

The Service may allow you to save favorites and presets (“User Content”). You retain ownership of your User Content. You grant Ambify a limited license to host, store, process, and display User Content only to operate the Service for you.

8. Intellectual property

The Service, including software, design, branding, and related intellectual property, is owned by Ambify or its licensors and protected by applicable laws.

9. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, if required by law, or to protect service integrity and security.

10. Disclaimer

The Service is provided on an “as is” and “as available” basis, especially during beta. We do not guarantee uninterrupted availability, specific feature continuity, or error-free operation.

11. Limitation of liability

To the maximum extent permitted by law, Ambify will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenues, data, or goodwill arising from use of the Service.

Where liability cannot be excluded, Ambify's total liability is limited to the amount paid (if any) for the Service in the 12 months before the event giving rise to the claim, unless applicable law requires otherwise.

12. Governing law and disputes

These Terms are governed by the laws of Germany, excluding conflict-of-laws rules. If you are a consumer, you may also benefit from mandatory consumer protections in your country of residence.

B. Privacy Policy

This Privacy Policy explains how Ambify collects, uses, shares, and protects personal data when you use the Service.

1. Data controller

Ambify is the data controller for personal data processed through the Service. Contact us at support@ambify.io.

2. Information we collect

  • Account data: email address, account identifiers, and session metadata.
  • Favorites and presets: saved mixer configurations associated with your account.
  • Access metadata: account role, beta status, and access-level flags required for service behavior.
  • Usage and technical data: device/browser details, feature usage, timestamps, and diagnostics.
  • Support communications: information you share with support.

3. How we use information

  • to provide and operate the Service (authentication, playback, presets, and support workflows);
  • to secure the Service, prevent abuse, and diagnose incidents;
  • to improve product quality and performance during beta;
  • to communicate important service updates and security notices.

4. Legal bases (GDPR/EEA)

Where applicable, we process personal data under these legal bases: contract performance, legitimate interests (security and product improvement), consent (where required for optional analytics/cookies), and legal obligations.

5. Service providers and sharing

We do not sell personal data. We may share data with trusted providers that help us operate the Service, including infrastructure, analytics, error monitoring, and email delivery providers.

6. International transfers

Some providers may process data outside your country. Where required, we apply appropriate safeguards such as Standard Contractual Clauses.

C. Refund Policy Status

Ambify is currently offered as a free public beta. No paid subscriptions or purchases are currently processed through the website.

Because there are no paid website purchases during beta, refund terms for website usage are not currently applicable. This policy will be updated before paid plans are introduced.
