This page explains the rules for using Ambify (the “Service”) and how we collect and process personal data when you use our website, apps, and related services.
A. Terms of Service
1. Who we are & what these Terms cover
Ambify (“Ambify”, “we”, “our”, “us”) provides ambient audio playback, mixing controls, presets, and related account features via our website and any associated services (collectively, the “Service”).
Ambify is operated by an individual based in Germany. These Terms of Service (the “Terms”) form a legally binding agreement between you and Ambify (the “Agreement”) and govern your access to and use of the Service. Our Privacy Policy and Cookie Policy are part of this Agreement.
2. Acceptance & eligibility
By accessing or using the Service, creating an account, or purchasing a subscription, you confirm that you have read and understood these Terms and agree to be bound by them.
You must be at least the age of majority in your jurisdiction to use the Service. If you are under the age of majority, you may use the Service only with consent of a parent or legal guardian (who will be responsible for your use). You may not use the Service if you are not legally able to form a binding contract.
3. Changes to the Service and Terms
We may update the Service and/or these Terms from time to time (for example, to reflect changes in features, technology, or legal requirements). Changes become effective when posted on this page unless stated otherwise. If changes are material, we may provide additional notice (e.g., in-app notice or email for registered users).
4. Accounts & security
If you create an account, you agree to provide accurate and up-to-date information and keep your credentials confidential. You are responsible for all activity under your account.
Account sharing is not allowed. You must not sell, rent, share, or transfer your account credentials or subscription access to others.

5. Plans (Free & Pro)
Ambify may offer a Free plan and paid Pro plans (monthly or annual). Plan features and limitations are described on our pricing pages and/or within the Service and may change over time.
6. License to use the Service
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal use, only as intended by Ambify.
7. Acceptable use (what you can’t do)
You agree not to misuse the Service. For example, you must not:
- attempt unauthorized access, probe/scan/test vulnerabilities, or bypass security measures;
- circumvent paywalls, subscription limits, or access restrictions;
- copy, scrape, harvest, or index the Service in a way that harms performance or violates these Terms;
- reverse engineer, decompile, or attempt to derive source code except where prohibited by law;
- interfere with the Service’s availability, integrity, or other users’ access;
- use the Service in ways that violate applicable law or third-party rights.
8. User content (favorites & presets)
The Service may allow you to save favorites (including presets and mixer configurations) (“User Content”). You retain ownership of your User Content. However, you grant Ambify a limited license to host, store, process, and display your User Content solely to operate and provide the Service to you.
Ambify does not offer user uploads or public sharing features at this time.
9. Intellectual property
The Service, including software, design, branding, and all related intellectual property, is owned by Ambify or our licensors and protected by applicable laws. You may not use our trademarks or brand elements without prior written consent.
10. Payments (Paddle as Merchant of Record)
Paid plans are billed through Paddle, our Merchant of Record and payment processor. Pricing, currency, taxes (including VAT where applicable), billing cycle, renewal terms, and plan details are shown at checkout and/or in your account billing settings. Ambify does not store full payment card details.
11. Automatic renewal
Subscriptions renew automatically unless canceled before renewal. You can manage or cancel your subscription from your account billing page. Unless otherwise stated, cancellation takes effect at the end of the current billing period.
12. Right of withdrawal (EEA/UK consumers) & digital services
If you are a consumer in the EEA/UK, you may have a statutory right to withdraw within 14 days for certain purchases. For digital services, you may be asked at checkout to expressly consent to immediate performance and acknowledge that this can affect your withdrawal right. If Paddle checkout presents these options, they will apply as shown at checkout.
13. Refund policy
First purchase refund window: your first Pro purchase is eligible for a refund request within 14 days, unless applicable law or the checkout terms state otherwise.
Renewals and subsequent purchases: after the first purchase, renewals and subsequent purchases are generally not refundable, except where required by applicable law or explicitly stated at checkout.
To request a refund or resolve billing issues, contact support@ambify.io. Refund handling may be processed through Paddle and subject to Paddle’s policies and checkout terms.
14. Suspension & termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the integrity and security of the Service. Where reasonable, we’ll attempt to provide notice.
15. Disclaimer
The Service is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free operation, and we disclaim all warranties to the maximum extent permitted by law.
16. Limitation of liability
To the maximum extent permitted by law, Ambify will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill arising from your use of the Service.
In any case, Ambify’s total liability for any claim related to the Service is limited to the amount you paid (if any) for the Service in the 12 months before the event giving rise to the claim, unless applicable law requires otherwise. Nothing in these Terms limits liability where it cannot be limited under applicable law (for example, certain consumer rights, intent, or gross negligence, where applicable).
17. Governing law & disputes
These Terms are governed by the laws of Germany, excluding conflict of laws rules. If you are a consumer, you may also benefit from mandatory consumer protection laws in your country of residence. Courts located in Germany shall have jurisdiction, unless mandatory consumer protection laws provide otherwise.

B. Privacy Policy
This Privacy Policy explains how Ambify collects, uses, shares, and protects personal data when you use the Service. It also describes your rights and choices.
1. Data controller
Ambify is the data controller for personal data processed through the Service. Ambify is operated by an individual based in Germany. You can contact us at support@ambify.io.
2. Information we collect
- Account data: email address, account identifiers, login/session data, and basic preferences.
- Favorites & presets: saved favorites including presets/mixer configurations associated with your account.
- Subscription data: plan type, billing cycle, payment status, and invoice-related metadata (processed by Paddle; we receive limited billing details).
- Usage & technical data: device/browser information, pages or features used, timestamps, and diagnostics/performance data.
- Support communications: information you send to support (email and message content).
3. How we use information (purposes)
- to provide and operate the Service (authentication, playback, saving favorites/presets);
- to process subscriptions, invoices, and customer support;
- to secure the Service, prevent abuse/fraud, and debug issues;
- to measure performance and improve the product (analytics with appropriate safeguards);
- to communicate important updates (e.g., security notices, billing messages).
4. Legal bases (GDPR/EEA)
If you are in the EEA/UK, we process personal data under these legal bases where applicable: (a) performance of a contract (providing the Service), (b) legitimate interests (security, fraud prevention, product improvement), (c) consent (optional cookies/analytics where required), and (d) compliance with legal obligations (e.g., tax and accounting via billing).
5. Service providers (processors) & sharing
We do not sell personal data. We may share information with trusted service providers that help us run the Service, such as:
- Payments: Paddle (Merchant of Record) for billing and subscription management.
- Audio storage & delivery: Cloudflare R2 (and related Cloudflare services) for storing and delivering audio assets.
- Hosting: Hetzner (Finland) for backend infrastructure.
- Analytics: Vercel Analytics (subject to your cookie preferences where required).
- Error monitoring: Sentry for application diagnostics and error reporting.
- Email delivery: Resend for transactional emails (e.g., verification and support replies).
We may also disclose information if required by law, to protect rights and safety, or to prevent fraud and abuse.
6. International transfers
Our primary infrastructure is in the European Economic Area (EEA), including Finland. Some service providers may process data in other countries depending on their operations. Where required, we rely on appropriate safeguards (such as Standard Contractual Clauses) for international transfers.
7. Data retention
We retain personal data only as long as necessary for the purposes described above. If you request account deletion, we delete your account and associated data from active systems promptly. Some residual data may remain temporarily in security logs or backups as part of routine operations and legal compliance, and will be removed in accordance with our retention practices.
8. Security
We use reasonable administrative, technical, and organizational safeguards (such as encryption in transit and access controls). However, no method of transmission or storage is 100% secure.
9. Your rights
Depending on your location, you may have rights to access, correct, delete, port, or restrict processing of your personal data, and to object to certain processing. If processing is based on consent, you may withdraw consent at any time.

10. Children
The Service is not intended for children under the age where consent is required by applicable law. If you believe a child provided personal data without appropriate consent, contact us to request deletion.
